Terms and Conditions

1. Scope and Contracting Parties

These General Terms and Conditions apply to lodging contracts for the apartments offered under the “Perfect Lodgings” brand. The lodging provider and contracting party is Schweinberger Vermietung GmbH, Münchner Straße 15, 6130 Schwaz. The contracting party is the person who makes the reservation; traveling companions are also considered guests.

Any individually agreed-upon terms take precedence over these terms and conditions. In addition, the General Terms and Conditions for the Hotel Industry (AGBH) of the Austrian Hoteliers’ Association, in their currently valid version, apply; these can be accessed at oehv.at.

2. Conclusion of the Contract

Bookings are made through the respective regional booking portal (book-zillertal, book-wiesing, or book-innsbruck.perfect-lodgings.com). The lodging contract is concluded upon confirmation of the booking by the lodging provider. Electronic communications are binding in this regard.

3. Scope of Services

Fully equipped, self-catering apartments are available for rent; hotel services or meals are not provided. The scope of services is determined by the description of the specific apartment booked. The exact address of the apartment will be provided with the booking confirmation.

4. Prices, Local Tax, and Payment

The prices listed on the booking portal apply. The accepted payment methods and payment terms are specified during the booking process. Final cleaning is included in the price.

A local tax (visitor’s tax) is charged separately and currently amounts to 2.60 euros per person per night in Hart im Zillertal, 2.60 euros in Wiesing, and 4.00 euros in Innsbruck; individuals are exempt until the end of the calendar year in which they turn 15. For longer stays, a change of bed linens is available for an additional charge of 35 euros per person.

5. Withdrawal and Cancellation

The terms and conditions of the booking portal or booking channel through which the reservation was made apply to cancellations and withdrawals. For accommodations booked for a specific date, there is no right of withdrawal in distance selling pursuant to Section 18(1)(10) of the FAGG.

6. Start and End of the Stay

Check-in is available starting at 4:00 p.m., and check-out is by 10:00 a.m. at the latest. These times apply without exception, as each apartment is thoroughly cleaned between stays. Access is contactless via a key box; the access codes will be provided well in advance of your arrival.

7. Guest Responsibilities and House Rules

Guests must comply with the applicable house rules. Smoking is prohibited in all apartments without exception; pets are not allowed. Only the number of people specified for the booked apartment may stay overnight; parties and events are not permitted. Quiet hours begin at 10:00 p.m.

8. Security Deposit, Inspection, and Liability

No security deposit will be collected. The host reserves the right to inspect the apartment before departure. The host is liable for items brought in by the guest in accordance with §§ 970 et seq. of the Austrian Civil Code (ABGB). The guest is liable for any damage caused through his or her own fault or that of accompanying persons.

9. Supplementary Application of the General Terms and Conditions of Business

To the extent that these terms and conditions do not contain any provisions, the General Terms and Conditions for the Hotel Industry (AGBH) of the Austrian Hoteliers Association, as amended from time to time, shall apply in addition.

10. Governing Law and Dispute Resolution

Austrian law applies, excluding its conflict-of-laws provisions and the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions, in particular those of the Consumer Protection Act (KSchG), remain unaffected. Schweinberger Vermietung GmbH is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Severability Clause

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.
